Directions for Review of Energy Utilization Manual

1. Ministry of Economic Affairs (hereinafter the Ministry) enacted the Directions for Review of Energy Utilization Manual pursuant to Regulations Governing the Assessment of Energy Development and Utilization.
 
2. The Ministry is the competent authority of the Directions, whereas Energy Administration, MOEA, is the executive agency.
 
3. When the Ministry accepts applications, the executive agency shall conduct formal review of Energy Utilization Manual.
When the Ministry accepts application amendments, the executive agency shall conduct formal review on the documents mentioned in the previous paragraph, as well as the Energy Utilization Manual amendment Comparison Table.
The Ministry shall notify the applicants that do not pass the formal review in writing to submit supplementary documents within 15 days, starting from the day after receiving the notice; applications will be rejected if the applicant does not submit supplementary documents in time, or the supplementary documents are incomplete, and the agency that accepts the permit application will also be notified.
The Ministry shall notify the applicants that pass the formal review in writing to pay review fees or amendments review fees within 15 days, starting from the day after receiving the notice. However, this does not apply to amendments that do not include volume, category, efficiency, or location. The previous paragraph shall apply to those who fail to pay the fees accordingly.
 
4. Substantive review shall be conducted by the executive agency on applications by applicants who have paid the review fees or amendments review fees according to Paragraph 4, Article 3 of the Directions.
 
5. To conduct substantive review of Energy Utilization Manual, the executive agency may establish advisory committee, recruit members based on the scope of the application, and convene advisory meetings. The opinions of the advisory committee shall serve as references for the executive agency’s review outcomes.
To conduct substantive review on application amendments, the executive agency may, upon inquiring committee members for suggestions, conduct advisory through written documents or meetings.
 
6. The executive agency may ask applicants to submit supplementary documents in any of the following situations regarding the substantive review of Energy Utilization Manual; applications will be rejected if the applicant does not submit supplementary documents in time, or the supplementary documents are incomplete, and the agency that accepts the permit application will also be notified:
(1) Documents and information submitted are insufficient to explain items including volume, category, efficiency, and location.
(2) Submission of erroneous calculation, indicators, or calculated outcomes.
(3) The Energy Utilization Manual includes any of the items in Paragraph 2, Article 4 of Regulations Governing the Assessment of Energy Development and Utilization.
The time period for submission of supplementary documents are not counted towards the time period of substantive review.
 
7. The Ministry shall notify the applicant in writing the outcome of the review, as well as the agency accepting permit application.
